THE recent Supreme Court of Appeal judgment restoring Kgosi Nyalala Pilane’s leadership and affirming the Bakgatla-ba-Kgafela Royal Family’s authority marks a significant turning point for the community in Moruleng. Years of instability and uncertainty have indeed delayed crucial social and infrastructure projects, hindering the community’s development.

 The Supreme Court of Appeal delivered a judgment on September 9, 2025, in an appeal brought by Kgosi Nyalala Pilane, the Traditional Council, and the Bakgatla-ba-Kgafela Royal Family.

The court ruled in favor of recognizing the reinstatement of Kgosi Nyalala Pilane.The judgment confirms that the Premier’s unilateral appointment of an administrator was unlawful due to the lack of a formal recommendation from the Royal Family.

It also affirms that the Premier had no authority to withdraw Kgosi Nyalala Pilane’s recognition certificate without valid reasons.The ruling upholds the constitutional principle that governance must be executed within the bounds of law.

It reaffirms the Royal Family’s authority as outlined in the North West Traditional Leadership and Governance Framework Act, 2005.The court’s decision presents an opportunity for the community to refocus on development and growth. With Kgosi Nyalala Pilane’s leadership restored, the community can now work towards rebuilding trust, accelerating development, and promoting unity among community members and stakeholders.

Ramono Mochudi Pilane’s spokesman Lebogang Phalafala said the Supreme Court of Appeal delivered a judgment on September 9, 2025, ruling in favor of Kgosi Nyalala Pilane, recognizing his reinstatement. However, Kgosikgolo Kgafela II’s lawyers weren’t notified of the May 7 hearing, potentially rendering the judgment invalid.
“The Royal Family, Kgosikgolo Kgafela II, and Ramono are South African citizens residing in South Africa, contradicting the judgment’s assumption that a resolution was taken in Mochudi and enforced in South Africa.”He said in a previous High Court hearing, evidence was presented showing Kgosikgolo Kgafela II’s and Ramono’s South African IDs, which supports their claim.

He emphasizes that the judgment is being appealed, citing concerns about the fairness of the process and the portrayal of the Mochudi royal family.He alleged that R5 million bounty on Kgosikgolo Kgafela II and his son Matshego Kgafela’s heads, put up by the “Moruleng Mafia.
